Terms of Service

Effective Date: November 25, 2024

1. Agreement to Terms

By downloading, installing, or using Crocheteer ("App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not accept these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Crocheteer ("we," "us," or "our") regarding your use of the App and related services (collectively, the "Service").

2. Eligibility and Account Registration

You must be at least 16 years old (or the minimum legal age in your jurisdiction) to create an account and use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial crochet and crafting purposes, in accordance with these Terms and Apple's App Store Terms of Service.

This license does not include the right to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Copy the App except as expressly permitted
  • Remove any proprietary notices from the App

4. Subscriptions and In-App Purchases

Freemium Model

Core features of Crocheteer are available for free. Premium features require a subscription ("Crocheteer Pro" or similar, name subject to change).

Billing and Renewal

  • Subscriptions are billed to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your device Settings → Apple ID → Subscriptions

Price Changes

Subscription prices may change with reasonable notice. You will be notified of any price changes and may cancel before they take effect.

Refunds

All purchases are final. Apple handles all refund requests for purchases made through the App Store. To request a refund, visit reportaproblem.apple.com.

Free Trials

If we offer a free trial, the trial period will be specified at the time of subscription. Any unused portion of a free trial will be forfeited when you purchase a subscription.

5. User Content

Ownership

You retain all rights to the patterns, images, notes, projects, and other content you create or upload to the Service ("User Content"). We do not claim ownership of your User Content.

License to Us

By using the Service, you grant us a worldwide, royalty-free, non-exclusive license to store, process, and display your User Content solely for the purpose of operating and providing the Service to you. This license ends when you delete your User Content or account.

Prohibited Content

You agree not to upload content that:

  • Infringes any intellectual property rights of others
  • Violates the privacy or publicity rights of others
  • Is unlawful, harmful, threatening, abusive, or harassing
  • Contains malware, viruses, or harmful code
  • Is fraudulent, deceptive, or misleading

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Interfere with or disrupt the Service or servers
  • Use automated scripts, bots, or other unauthorized means to access the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users
  • Impersonate any person or entity

7. Intellectual Property

The App, including its original content (excluding User Content), features, functionality, design, trademarks, and service marks, is owned by Crocheteer and is protected by copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the App or our intellectual property, except for the limited license granted in Section 3.

8. Termination

Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms or violate applicable laws. Upon termination, your right to use the Service will cease immediately.

Termination by You

You may delete your account at any time through the App settings or by contacting us at the email provided below. Deleting your account will remove your personal data as described in our Privacy Policy.

Survival

Sections 5, 7, 9, 10, 11, and 12 shall survive any termination of these Terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of any information obtained through the Service

Crochet patterns and instructions are for guidance only. Results may vary based on your materials, tension, and technique. Always follow safe crafting practices.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Crocheteer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or €50, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Crocheteer and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts of Poland, unless consumer protection laws in your jurisdiction require otherwise.

If you are a consumer in the European Union, you may also be entitled to submit disputes to the EU Online Dispute Resolution platform.

13. Changes to Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page. For significant changes, we will notify you via email or through a notice within the App.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
